SC jolts WhatsApp, Facebook, approves new privacy policy under scrutiny by CCI

New Delhi: WhatsApp and Facebook have got a setback from the Supreme Court. The Competition Commission of India (CCI) investigation will continue their proceedings regarding their new privacy policy. Both had sought a stay on passing orders from the Competition Commission citing the pending hearing in the Supreme Court regarding the validity of the new privacy policy.

The Supreme Court, while rejecting the application of Facebook and WhatsApp, said that the Competition Commission itself is an independent body, if it is investigating the violation of the Competition Act, then this investigation cannot be stopped. The Delhi High Court, on August 25, refused to stay the Competition Commission’s inquiry into WhatsApp’s new privacy policy. The High Court order was challenged by WhatsApp and Facebook in the Supreme Court.
