New Delhi: The Delhi High Court is to hear today (Monday) the demand for an SIT probe into the vandalism and attack on Delhi Chief Minister Arvind Kejriwal’s residence. A bench headed by Chief Justice Satish Chandra Sharma will hear the matter.
During the hearing on July 21, Delhi Police told the court that a charge sheet had been filed against 30 accused. During the hearing, senior advocate Abhishek Manu Singhvi, appearing for the petitioner, sought time to present the arguments. He had said that the case of the breach of a person holding a constitutional post should be investigated by the SIT. On behalf of Delhi Police, advocate Sanjay Law, while filing the latest status report on behalf of Delhi Police, said that a charge sheet has been filed against 30 accused in the case of vandalism at the Chief Minister’s residence. Sixty percent of the work of installing the gate near the Chief Minister’s residence has been completed, and the rest of the work will also be completed soon.
On May 30, Delhi Police filed a status report in the Delhi High Court. The status report said that eight people have been arrested and have been granted bail. Twenty people were issued notices for their involvement in the interrogation. The High Court had directed the Delhi Police to file a detailed report. The court had refused to give a copy of the status report to the petitioner. However, a copy of this was ordered to be sent to the Chief Minister’s Secretariat in a sealed cover. ASG Sanjay Jain, in a copy to be sent to the Chief Minister’s Secretariat, had sought the removal of the section on disciplinary action against policemen. The bench denied this and said that the full copy of the status report should be given to the Chief Minister’s Secretariat.
During the hearing on May 17, Delhi Police told the High Court that 22 to 23 security personnel had been deployed at the Chief Minister’s residence. RWAs are being discussed to install gates on both sides of the road. No gatherings or protests will be allowed near the Civil Lines metro station.
On April 1, the High Court summoned a status report from the Delhi Police on the violence at Kejriwal’s residence. The court had ordered the preservation of all the CCTV footage. The court recorded the statement of DCP North Delhi that all other evidence had been preserved. During the hearing, Singhvi demanded a notice from the Delhi Police in this matter. This demand from Singhvi was opposed by ASG Sanjay Jain, saying that Delhi Police had registered an FIR within 24 hours. Delhi Police are taking action. If a notice is issued on PIL, then a wrong tradition will be started.
During the hearing, the court said that we had seen the video. It was a chaotic crowd. The cameras were broken. People climbed the gate and tried to cross it. The mob had taken the law into their own hands. The court had said that the police arrangement at the Chief Minister’s residence was also not strong. On behalf of the Aam Aadmi Party, Saurabh Bhardwaj has demanded a probe by the SIT into this matter. The petition, filed through advocate Bharat Gupta, said that on March 30, the official residence of Chief Minister Arvind Kejriwal was vandalised by BJP goons. This incident was carried out under the guise of a demonstration. It has been said in the petition that the BJP goons broke the CCTV cameras with batons and climbed the gate, whose security is the responsibility of the Delhi Police.
It has been alleged in the petition that the role of the Delhi Police in this incident is also suspicious. It has been said in the petition that despite having Z plus security for the Chief Minister of Delhi, if such vandalism is done at his residence, then action should be taken against the responsible officers of the Delhi Police. It has been said in the petition that everyone has a constitutional right to protest through demonstration. But no one has the right to indulge in violence during the demonstration. In the petition, there has been a demand to constitute an SIT under the chairmanship of a retired judge.
